Terms and Condition of Contract of TFA

The following terms and conditions govern you (“you” or “user”) use of this website (the “site” being and referred herein as TFA). “TFA” means Trade Fair Accommodation CC, registered in South Africa under registration number 2005/034246/23

TFA is based in Cape Town, South Africa.  Use of the site is offered to the user conditioned on acceptance by the user without modification of the terms, conditions and notices contained herein.  Use of the content, services, and / or products presented in any and all areas of the site constitutes the users agreement to abide by the following terms and conditions.


“The client” means the person/ s, corporate or business who contracts with TFA on the terms and conditions hereunder. The client shall also include any agent who makes any booking of third party clients in respect of a reservation. Such agent, as well as the persons named on the provisional and the confirmed reservation form shall be jointly and severally liable to TFA for the performance of their obligations in terms of these standard trading conditions, as well as any contract / s made pursuant thereto.


“Services” means the provision of accommodation, transfers. Such services include, but shall not be limited to the procurement by TFA, acting solely as agent for the client, with third party service providers, of hotel accommodation and transfer reservations, and shall include any other services incidental to the aforegoing.  

These terms and conditions may be amended at any time. All amended terms and conditions shall automatically be effective upon being posted by TFA to the site.


TFA Acting as an Agent

In terms of these standard trading conditions, and any contract /s concluded pursuant hereto, TFA acts as agent only for and on behalf of the client in procuring the services. As such, TFA shall procure the services for and behalf of the client as agent for it with relevant third party service providers concerned. TFA shall, under no circumstances, be liable for the acts and omissions of the relevant third party suppliers concerned.


Modification of these Terms of Use
TFA reserves the right to change the terms, conditions, and notices under which the TFA website is offered, including but not limited to the charges associated with the use of the TFA website.

Quotations Procedure

Quotes can be requested either by filling in this websites quote form which will be emailed to our Consultants or you can email your request at any time to

Quotes will be returned to your email address in a presentation that can be given to your clients. The quote will include up to three hotels when available and include photographs, facilities, nearest public transport, price in the applicable foreign currency and ZAR rate of exchange (ROE) used. The ROE includes bank charges and commissions on purchase of foreign exchange (forex), VAT on the commission, Swift charge to remit forex abroad, Routing bank charges, Recipient bank charges (our principal requires funds net of bank charges) and Factor for deterioration of Rand exchange rate. The ROE is valid for 24 hours from quotation. The price quoted includes travel agents commission if applicable.

On acceptance of a quote, an invoice will be issued stating the Rand amount in total, the amount to be paid excluding the agents commission which is kept at source and the hotels cancellation period.

For South African travellers we will require the full names and residential address required by the South African Reserve Bank (SARB).


Items not Included in the Booking

Certain items are not included in the cost of the booking. These costs are the responsibility of the client including, but without limiting the generality of the a fore going, the costs of insurances as referred to below, insurance cover for cancellation and curtailment, repatriation costs, medical expenses, emergency evacuation, gratuities and beverages, optional meals and any optional excursion not reflected on the booking reservation. Furthermore, all costs with regard to any complying with any special requirements, as outlined in the Booking Procedure below, shall be borne by the client.


Booking Procedure

Bookings that are made and paid for within the 24 hour quoted period will not be exposed the ROE, however, after this period we reserve the right to re-invoice if the ROE has changed. Bookings that have not been paid for before the hotels cancellation period will be cancelled.

Bookings that are made within the hotels cancellation period will require a letter of guarantee for immediate payment and is not refundable.


Payment Procedure

Payment can be made directly into our bank account with electronic fund transfer (EFT, wire). Payments made by cash directly into our account will be subject to a cash deposit fee charged by the bank.  Once payment has been received, the travel vouchers will be issued.


Cancellation and Refund Policy

Cancellations of confirmed bookings may only take place according to the procedure outlined in this clause. All requests for cancellations shall be made by the client in writing to TFA and shall only be effective on the date of actual receipt by TFA. The following cancellation fees shall be applicable:

  • Booking before the cancellation date will receive a full refund less all bank charges, an administrative charge and exchange rate losses due to return payment from our offshore supplier. This refund will only be paid back once TFA has received it back into their account.
  • No refunds for bookings cancelled on or after the booking cancellation date.

Alterations to Itineraries

  • TFA has the right at any time, and in its sole discretion, to amend or cancel any of the services or the remainder thereof, or to make any alteration in accommodation, transportation arrangements in the event of the services or any part thereof rendered impossible, illegal or inadvisable due to force majeure, the definition of which includes war, strike, civil strife, riot, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions, governmental interference or any other external circumstances beyond TFA control.
  •  Any extra costs and expenses occasioned as a result of an alteration to or cancellation of itineraries as provided for above shall be payable by the client on demand by TFA
  • TFA may further in its sole discretion cancel or terminate a client’s booking for the services or any remaining part thereof in the event of any illness or the illegal or incompatible behavior of the client, who shall, in those circumstances, not be entitled to any refund. Any extra costs occasioned by such cancellation or termination as above shall be payable by the client on demand.

Child Policy

  • A child of 12 years and older will automatically be regarded as an adult and charged the full adult rate for all services provided unless otherwise agreed in writing by TFA.
  • Certain suppliers offer a discounted rate to children under 12 years old, however rates will be advised according to the itinerary requested at the time of booking.


Passports, Visas and Medical Requirements

  • TFA does not accept any responsibility for changes in medical requirements or regulations for visas or any particular visa requirements. Should the Client be refused entry to any country, due to incorrect or incomplete documentation or failure to comply with that country’s medical requirements, TFA shall not be liable for any costs of whatsoever nature occasioned thereby.


Default by Client and Recovery of Attorney and Own Client Cost

  • Overdue amounts due by the client to TFA shall bear interest at the prime rate of interest charged from time to time by  TFA’s Banks prime lending rate, plus 3 percentage points thereon, which rate may be proved by a certificate from any duly authorized official of the said bank, and shall constitute prima facie proof of the contents thereof. Such certificate may be used for the purpose of provisional sentence or summary judgment in any legal proceedings.
  • A certificate by any duly authorized employee of TFA or by any of its members shall be prima facie proof as to the outstanding amount due and payable by the client to it in terms hereof. Such certificate may be used by TFA for the purposes of provisional sentence or summary judgment in any legal proceedings.
  • In the event of TFA incurring any legal costs pursuant to any breach by the client of any of its obligations, the client shall be liable for and pay TFA costs thereby incurred, on the scale as between attorney and own client.


Applicable Law

These standard terms and conditions and all agreements entered into between TFA and the client pursuant thereto, and on the terms thereof shall be governed by and construed according to the laws of the Republic of South Africa, irrespective of the place where the agreement / s where entered into.



  • Subject to the provisions of the Magistrates clause below, any legal proceedings arising out of or in connection with these standard terms and conditions, or any agreement entered into pursuant thereto, shall be instituted in the Cape of Good Hope Provincial Division of the High Court of South Africa, which shall have exclusive jurisdiction to hear and determine such legal proceedings.
  • To the extent as may be necessary, the client hereby consents and submits to the jurisdiction of the said court, as referred to in High Court clause above.
  • Notwithstanding the provisions of the High Court clause above, TFA shall have the discretion to institute legal proceedings against a client in any Magistrate’s Court having jurisdiction in terms of Act no. 32 of 1944, as amended, notwithstanding that the amount claimed in such proceedings would otherwise exceed the monetary jurisdiction of the said Court.

Trade shows and events listed on TFA website are a guide only. TFA cannot be held liable for any inaccuracies and it is up to the client to confirm these listings details.

Variation of these Standard Terms and Conditions of Contract

No variation or alteration of these standard terms and conditions of contract shall be binding on TFA unless embodied in a written document signed by a member of TFA. Any purported variation or alteration of these standard terms and conditions of contract otherwise than as set out above shall be of no force or effect, whether such purported variation is written or oral, or a combination of both.



No extension of time or relaxation of any of the provisions of these standard terms and conditions of contract shall not operate as estoppel against TFA in respect of its rights herein, nor shall it operate so as to preclude TFA thereafter from exercising its rights strictly in accordance with these standard terms and conditions.
